You're welcome and thanks for the feedback, it really does help. Haven't quite been feeling like myself of late. Nothing bad happened or anything I'm just I dunno drained. :|

thanks for the heads up... at my DA page i'll do the same thing... i thought it was a sort of advertising, but i take your point

Yeah thanks. Dave never minded anyone using the backgrounds but once you change it you've invalidated the copyright anyway. Then it looks like something MPV created.
It's a dirty job but I got to do it for 27 years. Thank you.

now that i'm about to post one of my DA stories with Anabelle Pync, it occurs to me... Muckerman is changing the image in a significant (and wonderful) way; but i keep the image intact and just add story captions--- i'm including a sample--- it's different from what people would find on MPV, but not as much... still best to remove the copyright?

While I am no attorney, copyright or otherwise, my understanding is that what is technically correct when a portion of a copyrighted work is used in a derivative work, and assuming it is used with permission, would be the following:
1. Do whatever the holder of the copyright for the relevant work requests when granting permission,

or

2. To say "Portions copyright (with the proper name and year)" The word "portions" might be changed to something more specific, such as "Background", again according to the wishes of the copyright holder.

Doing it this way preserves the original copyright, should prevent subsequent derivative works without permission, and does not claim a copyright by whomever did the derivative work.

I am unsure how the person doing the derivative work can properly claim copyright for the derivation, but I expect there is a way to do so.

This goes beyond the copyright as it's not anyone's image to play with. Borrowing backgrounds is one thing but to take the whole image and rework it to another's benefit is morally wrong and illegal. It's also confusing to the customers because MPV did not create it. Can anyone tell me where picture come from?

Again I am not an attorney (I don't even play one on TV) but I think I am on pretty solid ground here (yeah I know the site is about quicksand). The key to knowing what to do is "permission." The creator of a work derived from someone else's copyrighted work must do what is requested when permission is granted, and IF it is granted. Further, if party A grants permission to party B to use party A's copyrighted work, that does NOT automatically grant anything to party C. Party C must seek permission from party A and it is quite possible it could be denied or granted with different terms.

Things get even more complicated when party C wishes to make a derivative of party B's derivative of party A's copyrighted work if party B claims copyright to part of party B's work. In that case permission must be obtained from both A and B.
